1. Definitions

“Company”, “we”, “us”, “our” refers to Noremac Group (and any affiliated entities).

“Customer”, “Client”, “you”, “your” refers to the individual or business who uses our services, rents equipment, or accesses our website.

“Services” refers to any services offered by us, including but not limited to concrete pumping, stone slinging, waste management, site fencing, portable restrooms, equipment rental, transportation, delivery, and related site services, as described on our site.

“Equipment” refers to any machinery, tools, materials, or other rental items provided by us under a rental arrangement.

“Agreement” means these Terms & Conditions, and (if applicable) any written rental agreement or service contract between you and us.
2. Scope & Acceptance
By accessing our website or using our services or equipment, you accept and agree to be bound by these Terms & Conditions. If you enter into a separate rental or service contract, that contract — together with these Terms — governs your relationship with us.
We reserve the right to amend or update these Terms at any time. We will post updates on our website, and continued use of our services after changes constitutes acceptance.
3. Equipment Rental / Service Terms
3.1 Equipment Description & Condition

All rented equipment will be described in writing (e.g. make/model, serial number, condition) before rental begins.

You agree to inspect equipment upon delivery and notify us immediately of any damage or defects.
3.2 Rental Period & Use

The rental period, including start and end dates (and times, if applicable), will be specified in the rental agreement. Early returns, extensions, or late returns may be subject to fees.

You agree to use the equipment only for its intended purpose, in compliance with all applicable laws, regulations, and instructions.
3.3 Fees & Payment

Rental/service fees, payment terms, delivery or setup charges, and any other applicable costs will be detailed in a quote or agreement.

For longer-term rentals, regular payment intervals, advance payments, or billing terms may apply.

Late payments may incur interest or fees as specified in the agreement.
3.4 Obligations & Responsibilities of the Customer
During the rental period you agree to:

Operate the equipment only by competent, qualified, and authorized personnel.

Use and maintain the equipment safely, lawfully, and in accordance with manufacturer specs and local regulations.

Keep the equipment free from liens, seizures, or encumbrances.

Provide, if required, proof of adequate insurance coverage (liability, property, replacement value) naming Noremac Group as an additional insured, and notify us of any policy changes or cancellations.

Cover all costs for permits, licenses, taxes, or assessments related to the use or transport of the equipment, if required.
Failure to comply may result in termination of the agreement, repossession of the equipment, and liability for damages or associated costs.
4. Liability, Warranties & Indemnification
4.1 No Warranty / “As-Is” Use
Equipment and services are provided “as-is” and “as available.” We make no warranties — express or implied — regarding suitability for a particular purpose, safety, compliance with local laws, or uninterrupted availability.
4.2 Limitation of Liability
You assume full responsibility for use of the equipment or services. Under no circumstances will Noremac Group (or its officers, employees, agents) be liable for any indirect, incidental, special, punitive, or consequential damages (including loss of profits, delays, or loss of business).
4.3 Indemnification
You agree to defend, indemnify, and hold Noremac Group harmless from any claims, liabilities, losses, damages, costs, fines, or legal fees arising out of your use or misuse of the equipment or services — including but not limited to injury, property damage, regulatory violations, or environmental impact.
5. Delivery, Transportation & Site Services
If delivery, setup, transportation, or installation services are included:

You remain responsible for safe access to the site, compliance with local regulations, permits, including traffic, environmental, or zoning permits.

You must provide accurate site information (address, access conditions, load restrictions, contact person) at the time of quote or ordering.

You are responsible for any additional costs, delays, or damages due to incorrect or incomplete site information provided by you.
6. Cancellation, Termination & Return of Equipment / Services

Either party may terminate the rental/service agreement if the other party materially breaches the terms (e.g. non-payment, reckless use, breach of obligations).

Upon termination or end of rental period, you must return the equipment in the same condition (ordinary wear & tear excepted) as it was provided.

You are responsible for all cleaning, removal, transport, and any damage or loss incurred during rental or return.
7. Governing Law & Jurisdiction
These Terms & Conditions — and any agreement between you and Noremac Group — will be governed by the laws of the province(s) in which the services are provided (e.g. Alberta or British Columbia), and applicable federal laws of Canada. Any disputes will be resolved in courts of competent jurisdiction in those provinces.
8. Changes to Terms & Notice
We reserve the right to modify or update these Terms at any time. We will post the updated Terms on our website. Your continued use of our services or equipment after such changes constitutes acceptance of the updated Terms.
